§ 1. General provisions
These Terms set out the rules for using the NexWatt service available at nexwatt.eu (hereinafter: the Service).
The Service Provider is L4T Leszek Filipów ul. Pawła Pośpiecha 5, 44-300 Wodzisław Śląski. Contact: kontakt@coreinfra.eu.
Definitions: User — a person using the Service; Customer — a person or company for whom the account was created; Installation — a home or facility with energy devices; Connector — an ESP32 board with HEMS software on the Customer's local network; Package — the scope of features and limits of the account.
These Terms constitute terms for the provision of electronically supplied services within the meaning of the Polish Act of 18 July 2002 on the Provision of Electronically Supplied Services (ustawa o świadczeniu usług drogą elektroniczną).
§ 2. Type and scope of services
Public pages without login: RCE energy prices, installation map (aggregate data), service status, list of supported devices.
Panel account: energy monitoring of the installation, measurement history, production and consumption forecasts, battery operation schedule, alerts, reports, recommendations (including AI-generated ones) and — in plans that include it — device control.
API for integrations (API keys with permission scopes) and connector software with remote updates.
The scope of features and limits depends on the Package. A description of the Packages is available in the panel (Package).
§ 3. Technical requirements
A web browser with JavaScript support (current versions of Chrome, Edge, Firefox, Safari) and internet access.
Flashing the connector software via the browser (Web Flasher) requires a browser with Web Serial support (Chrome or Edge on a computer).
The connector requires an ESP32 board listed on the “Supported devices” page, a 2.4 GHz Wi-Fi network with internet access (outbound HTTPS connections) and devices with a supported communication interface.
Use of the internet involves typical risks (e.g. malware, interception of data). The Service Provider uses encrypted connections and the security measures described in the Privacy Policy.
§ 4. Account and agreement
An account is created via the registration form (with acceptance of the Terms and the privacy policy) or by invitation. The service agreement is concluded upon account activation, for an indefinite period.
The Free Plan is free of charge. The terms and price of paid Plans are provided before they are ordered; the Plan is changed in the panel or by the Service Provider at the Client's request.
The Customer may terminate the agreement at any time by deleting the account in the panel (Privacy). Data is deleted after 14 days, during which the request may be withdrawn.
The Service Provider may terminate the agreement with 30 days' notice for valid reasons (e.g. discontinuation of the Service) or without notice in the event of a gross breach of the Terms.
§ 5. User obligations
Providing true data, protecting the password and API keys, and promptly reporting any suspected unauthorised access.
It is prohibited to provide unlawful content, attempt to circumvent security measures, load the Service beyond its limits, or use other users' accounts.
Devices shall be connected in accordance with the manufacturers' instructions and applicable regulations; work on the electrical installation shall be carried out by a person holding the required qualifications.
§ 6. Device control and safety
Every command to a device passes through the Service's command gateway, which verifies permissions, the Plan, the device's declared function scope and energy storage constraints. AI and automation do not control devices bypassing this gateway.
Automatic control operates only in production mode enabled by the Client; the Client may stop it at any time (emergency stop in the panel).
Device protections (inverter, BMS, heating controllers, chargers) operate locally and independently of the Service. The Service does not replace these protections.
If connectivity is lost, the connector applies the behaviour declared for the given device function (safe state, reverting to the device's setpoint, or holding the last value).
Device drivers are marked with a verification status; an “unverified” driver requires the Client to check the readings before enabling control.
§ 7. Data, prices and forecasts
RCE prices come from Polskie Sieci Elektroenergetyczne (PSE, Polish Power Grid operator) and are for information purposes only; billing of the customer is carried out by the energy supplier under its agreement.
Forecasts (of production, consumption, prices) are estimates with the method stated and do not constitute a guarantee. The Service does not guarantee any specific savings.
Results and reports are based on measurements from the Customer's devices; a missing measurement is shown as no data.
§ 8. Service availability
The Service Provider strives to ensure continuous availability of the Service. Maintenance work and outages are announced on the /status page.
The connector stores measurements locally during connectivity interruptions and sends them once connectivity is restored, within the limits of the device's memory capacity.
§ 9. Complaints
Complaints concerning the Service may be submitted to kontakt@coreinfra.eu or via the support request form in the panel. A complaint should include contact details and a description of the problem.
The Service Provider responds to a complaint within 14 days of its receipt, to the e-mail address provided in the complaint.
§ 10. Consumers
A consumer may withdraw from a paid Plan agreement within 14 days of its conclusion without giving any reason, by submitting a statement to kontakt@coreinfra.eu. If, at the consumer's request, performance began before the expiry of that period, the consumer shall pay for the services provided up to the time of withdrawal.
A consumer may use out-of-court dispute resolution methods, including the assistance of a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) and the Voivodeship Inspectorate of Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej).
The provisions of the Terms do not exclude or limit consumer rights arising from generally applicable law.
§ 11. Liability
The Service Provider is liable for the proper provision of the Service on general terms. With respect to Customers who are not consumers, liability for lost profits is excluded, and total liability is limited to the fees paid for the last 12 months.
The Service Provider is not liable for the operation of third-party devices and services (inverters, manufacturers' clouds, grid operators, internet service providers) or for the consequences of incorrect device connection.
§ 12. Amendments to the Terms and final provisions
The Service Provider shall notify of any change to the Terms by e-mail at least 14 days before it takes effect; a Customer who does not accept the changes may terminate the agreement before that date.
Matters not regulated herein are governed by Polish law. The Polish version of the Terms is binding.
